Damage to your car, your car should be repaired properly, or you should be paid for its loss in value, or replacement cost. In some instances the car is “totaled”. Totaled means that the cost of repairing the vehicle is more than the fair market value of the vehicle.

Questions can arise when the insurance company claims the car is totaled, but offers less than the amount owed on the car loan. Texas law only mandates that the insurance company pay for the fair market value of the vehicle, not the balance of the loan. This often causes difficulties for persons who have newer vehicles. Problems arise because newer cars with loans of four and five years, are often worth less than the loan balance for a substantial part of the loan period. Thereafter, in some instances, a vehicle owner is not only left without a vehicle when a car is totaled, but also left giving money to a bank on the car loan. For this reason it may be a good idea to purchase “gap” insurance. (find good information site that talks about gap insurance and hyperlink to the word gap) This insurance pays the difference between the fair market value of the vehicle and the balance of the loan and the fair market value of the vehicle.

One more option maybe to keep the car. Under Texas law the responsible insurance company has a choice, it can either pay for the vehicle to be repaired, or declare the vehicle totaled and pay the owner for the vehicle’s fair market value. Obviously, the carrier will choose the cheaper option.

The choice belongs only to the insurance carrier. However, the carrier will often agree that the vehicle owner can keep the car, even if it is totaled. In these cases, the salvage value of the car is deducted from the amount that the vehicle owner would otherwise have been paid. This may make sense to car owners who believe they can have the vehicle repaired.
Benefit No.2:

Rental Car, Texas law mandates that when the vehicle is going to be repaired, the insurance company for the at-fault driver has to either pay for a rental car or reimburse the vehicle owner for the rental car expense.
Benefit No. 3:

Medical Care, You are entitled to be put back into the same physical condition you were in before the accident occurred. You do, however, need to go to the right type of doctor. Many doctors do not provide the kind of care that accident patients need. For example, family and primary care physicians, do not usually render the necessary attention and treatment.
